Summary

In the first part of this work, I recover the Cyberspace Declaration of Independence, the emotional text written by John Perry Barlow, one of the lyricists of the legendary rock band Grateful Dead. In that document was expressed the naïve emancipatory spirit that prevailed in cyberspace. In the second part I highlight the importance of the neutrality principle of the network, and I refer to the most relevant associated principles. The end of net neutrality affects most associated principles. In the third part of the text I present the main arguments of the defenders of net neutrality, as well as those who operated to eliminate it. In the fourth part, I refer to the most outstanding events in this debate, which by far transcends the Internet and telecommunications industries in the United States. Its repercussions will be global. In the fifth and last section, I describe how Ajit Pai, president of the Federal Communications Commission (FCC), operated to fulfill the task entrusted to him by President Donald Trump: to eliminate the net neutrality.

Summary

 

            In this paper, we seek to focus on a phenomenon of unstoppable expansion such as the use of the Internet networks in the information and communications system.

What we propose to highlight here is the consequences that may derive from an unsustainable use of this tool. The Internet, as a vehicle of obvious importance in many realities, has contributed to improving the social conditions of men. Just think of the simplified access to information or of the recognition of personal moments of expression that have led many socio-political debates horizontally up to the creation of platforms that allow expressing opinions on the work of certain ruling classes.

The global dimension of the phenomenon and its ability to penetrate the social fabric has encouraged the masses to enter the circle of opinion leaders, generating an inversion of the tendency of information itself, so that by means of the asseveration of freedom and symbol of collapse of the barriers its use has denied the original libertarian design facilitating disinformation, propaganda and populism, in a vicious circle of visibility at any cost that involves mass media, governments, organizations and users themselves.

The mobilization towards this type of information has also shifted propaganda to a terrorist and criminal background, facilitating the transmission of messages and recruitment activities and benefiting from the greatest difficulties of the investigative departments.

The theory we are trying to report is based on a setback that leads to the search for a center of gravity of social and cultural balance that moves from personal awareness and requires a management system that knows how to ring a new concept of education and training towards individuals, able to relate and face the challenges that cyber-space poses.

Summary

More than a decade after its publication, the Spanish Code of Self-regulation on Children and TV is still an inefficient instrument to protect minors in the audiovisual landscape. This fact, alongside with changes in the audiovisual realm, recommends some reflections about what has gone wrong in that Code, in order to correct its defects and establish a more efficient and transparent self-regulating system. This article contains a proposal to achieve this objective

Introducción al número 25 de la revista

Como se apuntaba en la invitación a presentar colaboraciones para el número 25 (Nueva Época) de nuestra revista, dedicado a la “Democracia, libertad de información y redes sociales”, coordinado por Elías Said, profesor de la universidad española UNIR, nos encontramos en un contexto social que exige una profunda reflexión sobre el papel que deben asumir las personas ante los impactos que están trayendo consigo los escenarios digitales actuales. En especial, en lo que se refiere a la promoción de la transparencia, la gestión de la información, la privacidad, la libertad y otros aspectos que adquieren cada vez mayor relevancia.

Este número comprende un total de nueve aportaciones venidas de muy diversas latitudes, en el marco de la colaboración CIESPAL-DERECOM, distribuidas en dos de las cuatro Secciones más habituales de esta publicación académica (Artículos de fondo y Opiniones). Se trata de una muestra de la diversidad de temas relacionados con la multiplicidad de procesos revolucionarios en el ámbito de las comunicaciones que están viviendo las sociedades contemporáneas, pero también de los enfoques que pueden ser tenidos en consideración para afrontarlos.

La Sección “Artículos de fondo” abarca siete trabajos; por un lado, los publicados por Bongarzone, con el título “Il registro degli accessi: profili per una nuova gestione dei flussi documentali” (“El registro de accesos: perfiles para una nueva gestión de los flujos de documentos”), Martínez Otero, titulado “La necesaria reforma del Código de Autorregulación sobre Contenidos Televisivos e Infancia: una propuesta de mínimos (pero ambiciosa)”, y Lucas Tobajas, que aborda “La protección de los usuarios con necesidades especiales en el sector de las comunicaciones electrónicas”, ayudan a tratar el tema central de este número desde la perspectiva de la gestión documental, de la regulación de contenido y de la necesidad de promoción de mecanismos de protección de los usuarios, tanto a nivel general como para la población infantil.

Por otro lado, también se encontrarán artículos como los propuestos por Kaufman, con el título “Redes, medios, violencia y democracia. Escenarios de debilitamiento institucional y desconfianza ciudadana”, Legarreta, titulado “Capitalismo disruptivo: la red global digital y la colonización de las mentes y Luchessi, con el título “Desafiar la democracia, someterse a la corporación” . Todos ellos permiten un contacto más directo con planteamientos que nos invitan a pensar en el escenario digital actual y en la democracia desde una óptica claramente crítica y preocupada por el potencial impacto negativo que el ámbito electrónico pueda tener sobre nuestras democracias y sobre la formación de opinión pública, en la actualidad. La preocupación de los autores, investigadores y docentes universitarios es evidente y profunda y la lectura de sus textos y la reflexión posterior nos lleva a compartirla.

En la Sección “Opiniones” los trabajos de Islas, con el título “ El fin de la neutralidad de la red. El fin de la utopía”) y Zaffino ( “Informazione e massificazione: il deficit educativo. eravamo davvero pronti?”) (“Información y masificación: el déficit educativo. ¿estábamos realmente listos?”), permiten seguir afrontando, de forma crítica, el tema central propuesto para este número, pero prestando especial atención a dos cuestiones: el valor de la neutralidad de Internet, tema candente desde que el presidente de los Estados Unidos provocara, meses atrás, un cambio legal que suponía apartarse del enfoque de la Unión Europea con relación a la misma cuestión de la neutralidad, así como la capacidad que tenemos hoy las personas a la hora de enfrentarnos a la gran cantidad de información y a la masificación de contenidos que nos llegan con la ayuda de las competencias educativas disponibles hoy.

Summary

In the last years transparency and simplification have been for the Italian legislator the main values-goals to innovate the Public Administration. Immediate consequence of the administrative transparency is the right to access public documents, the civic simple and generalized access. Now the person in charge of documents flows faces the introduction of the Access Register which is a tool for the right management of the IT protocol.

The defamatory political campaigns detected in the Trump election process, with the intervention of global Internet corporations, and companies such as Cambridge Analytica, generated an unprecedented debate about the negative impact of social networks, embedded in global corporations who handle our data darkly. The media scandal policies provide the rest. It aims to increase political discredit and distrust of institutions so that democracies are turning towards totalitarian forms, functional to corporate interests, while citizens wander

between disinterest, misinformation, polarization over banal issues or, what is more serious, disconnected from the others, in scenarios of self-exploitation and narcissism.

Summary

This paper aims to identify the ecosystem in which the technology corporations develop themselves, the historical material conditions that have allowed the private appropriation of others’ work to overexceed the limits of individual workforce. This is possible by shredding ideas, wishes, feelings and personality traits through processes of digitalization. The author proposes that the history of the Internet is the history of the struggle between managers, on the one hand, who represent the scientific-industrial-military complex that has monopolized and privatized the global network, and hackers, on the other hand, who represent a sector that understands and develops makes the Internet to evolve but struggles to make public the way in which the system operates, to eliminate private profit by means of a common good and to generate an alliance with the world population for the emancipation of humanity.

Defying democracy, surrendering to corporations

Summary

In the face of a new political scenario in Latin America, the irruption of communities into digital social media plays a fundamental role in the erosion of democratic institutions.

Users´ perceptions of their interactions with peers, which are not mediated by political or news institutions, make them question and discredit the bodies that had regulated their political lives up to date.

The questioning and distrustful look over State representatives, political corporations and opinion shapers does not correlate with the new actors defining social, political and cultural guidelines within the private sector.

Therefore, while citizens fear the way the State will use the information collected from them, the handing over of sensitive data from those very citizens to transnational corporations which hold dominant positions in the global market is not called into question. Neither is how those data are being used by these companies to monetize their business and erode the democratic system.

The manipulation of information deriving from the analytics collected by these corporations, which can be used to manipulate elections or define health policies, has brought about consequences in specific countries, but threatens the principles of liberty and equality of the whole system.

This work is concerned with the analysis of the actions of users on the Internet, their impact on the construction of news and the weakening of democratic institutions in the second decade of the 21st Century.

Summary

 

The evolution of the Information Society and the effective fulfilment of the goals set by the Digital Agenda for Spain require the progressive adaptation of the citizens until reaching the full digital inclusion, in which it is essential to guarantee the electronic access of those citizens to a certain number of digitized public services. The existence of the so-called digital gap reveals effective lacks in a specific sector of the population, both in the access to the network and in the access to the basic telephone service, giving rise to a new category of users that could be called vulnerable clients, properly speaking. This issue requires an in-depth analysis of the content of the universal telecommunications service, in order tackle the different social needs that arise.
