Introducción al número 24 de la revista

Como, a menudo, nos sucede, cada número de esta revista es una sorpresa. Solo cuando hemos leído todas las propuestas y seleccionado, de la mano de nuestros árbitros, las que encajan en la línea editorial, tenemos la impresión de que estamos al día en los temas que realmente preocupan a los estudiosos del Derecho de la Información o de otras disciplinas conexas con el Derecho de la Información o que de alguna manera aportan conocimientos o reciben conocimientos de nuestra Ciencia.

Este número, por ejemplo, es una muestra palpable de que las preocupaciones sociales, de la sociedad española, son las inquietudes de los pensadores, intelectuales, estudiosos o ensayistas; las cuestiones medioambientales, de nuevo, sobre la mesa, en relación con la falta de información o con la incorrecta gestión del deber de informar por parte de las autoridades locales o regionales. Este es el tema sobre el que opina el equipo que encabeza Carmina Elvira, a quien acompañan Luis Moral y Salvador Elizalde.  La regulación legal de la violencia de género y el rol de los medios de comunicación en la difusión del conocimiento del delito es otro asunto de plena actualidad que, aquí, aborda Melania Palop. Incidiendo aún más en la cuestión de género, Miguel Ángel Barbero profundiza en la lucha de las mujeres golfistas españolas en todos los órdenes, incluyendo el jurídico, para destacar la desconsideración de su derecho a la imagen por parte de los propios órganos gestores del deporte. Las tecnologías y su repercusión en un derecho tan fundamental como el de las convicciones religiosas es un tema que aborda Sebastian Ciancio. La emigración mejicana, en la región española de Cataluña, como modelo de soft power es otro ejemplo de asunto de actualidad inesperado en una publicación como la nuestra. No obstante, tiene su sentido en la medida en que se trata de un análisis cuantitativo sobre medios de comunicación, tratando de orillar, precisamente, el Derecho, la fuerza y la coacción y buscando actuar por el  lado de la diplomacia, el tacto y las buenas prácticas. Así lo contempla José Ramón Santillán. De la tercera edad se ocupa Olga Pérez Arroyo, en un trabajo sobre los abusos cometidos por descendientes que, sin embargo, osan reclamar su herencia al fallecer sus familiares más cercanos, sus padres, a los que vejaron, injuriaron o calumniaron en vida y, precisamente, en los últimos años, los más difíciles, de sus vidas, siendo las injurias uno de los delitos típicos en el estudio del derecho a la información. Daniel Montaño se aproxima a las emisoras de radio comunitarias, en Méjico, lo que es también un reflejo de los derechos de participación y transparencia en las sociedades avanzadas del siglo XXI.

Terminando, prácticamente, llega el agudo trabajo académico de Laura Caballero, sobre el honor, un derecho nunca suficientemente estudiado, el de Serafín Chimeno, con su reflexión decidida sobre el periodismo y la justicia, y la reseña de Félix Rebollo sobre la obra de Boix Palop, Martínez Otero y Montiel Roig Regulación y control sobre contenidos audiovisuales en España (Thomson Reuters Aranzadi, 2018).

Summary

The correct use of the Internet is now an essential element of discussion in the legal landscape of world communication. Internet services have significantly expanded the boundaries of communication, changing the logic, habits and behavior of users. Thus the urgent need to protect the right to freely express one's own thought also in religious matters is recognized, through the web.

Summary

In this paper we examine the problems that exist in the southern area of the State of Tamaulipas, Mexico, referring to the lack of compliance by the authorities with the right to information of citizens, including both public service transport providers  and the population of  the municipalities in that State. This failure of the administrative authorities comes from  the fact that they do not inform citizens about the pollution caused by public transport and its relationship with climate change.

To sort out the above mentioned issue, authorities, in the first place,  should implement an efficient and effective public policy whose practical measures could prevent the disaster from happening, such as the implementation of a regulatory framework, the creation of  air quality monitoring system and the setting of programs devoted to reduce the current pollution and to avoid the climate change. In the second place, public transport operators and citizens, according to their right to information, should be duly informed of what has been done in relation with this matter by local authorities. Thus , the joint action would produce a coparticipation to sort out the dangerous state of affairs that prevails in the area, for the   improvement of air quality and the very same quality of life of the population.

Summary

In this paper, we present a research about the Mexican soft power in Catalonia through the newspapers La Vanguardia and El Periódico de Catalunya during the years 2013 to 2016.  A  sample of one hundred ten news, considered to be sufficiently representative, allows us to practice a quantitative analysis whose results show that these newspapers are building an image of Mexico as a country of cultural power and economic strength. The Mexican cultural subjects that receive the widest coverage are literature and cinema, music and theatre, immigration, education, tourism, gastronomy and historical heritage.

                Economically speaking, those pieces of news underline Mexico as a country that provides the opportunity to invest, financially steady and where the quality of companies and products is high. These great strengths are also framed in the broader context of the relationship with Spain.

Another conclusion is that writers, filmmakers, artists, singers, cooks, academics, students and the Mexicans settled in Catalonia are the main promoters of this soft power favourable to Mexico.

Summary

In the summer of 2014 the Spanish press spoke of a novel jurisprudential expansion of causes of deprivation of the legitimate inheritance line. The descendants could be disinherited by their parents if it is proved that the ascending family members had been victims of psychological abuse. The media were not oblivious to the component of human interest  awoken by the judgment of the Supreme Court´s First Chamber,  in June the 3th, 2014. The mass media coverage of that judgment expanded its echo beyond the judicial circles and the legal profession. The media headlines presented the message happily as it had been a social demand for some time.  Thus, many parents could deprive of his own property the one who to some extension they felt as an intruder, be him or her of his very same blood or an adopted child.

Here we try to make a jurisprudential, theoretical and reflective review of how the courts  make up caselaw, in this case, focused on the disinheritance by parents of their descendants on grounds of  psychological abuse. The mass media play the role of disseminators of this judicial information, taking into account  the human interest of these stories and facts. This paper proves that judges in Spain might be considering the human interest of newspaper stories to right certain wrong situations in our secular statutory minimum share of a  descendent's estate.

Summary

In this paper the section 172 ter of a new crime called "stalker" is analyzedalong with the crime of gender violence. The hypothesis of the problem is: Before a complaint or in case of lack of a complaint by the woman who is a victim of gender violence and, therefore, based upon this, a restraining order or an order of probation is applied. One could ask what happens when there is recidivism in breach of the above mentioned restraining  orderor supervised freedom.  For example, let us consider the approach to the victim and, therefore, the consummation of the crime of stalker. In this case, currently,  the top penalty is the same for both cases: recidivists and non-recidivists.

Therefore, our aim is considering that the penalty applied to the aggressor in the above mentioned section has a gap with respect to the recidivism (recognized or not judicially) in the crime of gender violence  given the seriousness of the damage to  fundamental rights. Including in section 172 ter two new cases concerning repeat offenders and non-repeat offenders, aggravating the penalty in the first case, is a neat need.

Professional female golf has always been very successful for Spanish sport, but it has not been that way through the years. Female golfers had to jump over multiple obstacles in order to get the right of living of his job and even today have many problems to do so. This paper shows some of the problems these women had to solve for more than a century in social, justice and sporting matters and the current situation they find themselves now as a group.

Summary

Is honour predicable to Legal Persons under Public Law? What defensive actions can be raised in the face of an eventual breach of this right? What possibilities would an application for amparo have to thrive? This article analyzes the scope of the right to honour contained in article 18.1 CE, in order to determine if it is possible to articulate the defense of its good name around a broad meaning or, on the contrary, around a restrictive sense.

In its broad meaning, the defense would be anchored in the right to honuor, with the corollary of advantages, both substantive and procedural. But if it is only possible to articulate the defense in its most restrictive aspect -the right to a good name- the aforementioned prerogatives are missed.

Thus, the core issue lies around the ownership of the fundamental right. And, given that honour is an undefined legal concept, it is necessary to resort to its jurisprudential configuration, a task that is tackled by the High Court and, above all, in the Constitutional Court. However, although both tribunals have not been in favour of granting the entitlement of the right to Legal Persons under Public Law, there is no yet a consolidated doctrine.

Therefore, the conclusions we reach will allow us to establish the baselines, in order to determine if it is possible to articulate the defense of Legal Persons under Public Law around an application for amparo or if, definitely, the aforementioned option is an entelechy.

In this paper, we seek to expose the problems and challenges, both new and persistent, for the existence and functioning of community radio stations in Mexico, given the legal, political and social scenario that follows the Constitutional Reform in telecommunications and broadcasting, and the entry into force of the Federal Law of Telecommunications and Broadcasting.
