Introducción al número 29 de la revista

Da comienzo el curso académico 2020-2021 y, con él, se publica el número 29 de nuestra revista. No hay duda de que es éste un curso particular. Si ya la pandemia se hacía notar en el número de marzo 2020, ahora, con más motivo, puesto que la enfermedad no nos abandona y, lejos de ello, soportamos la mayoría, en nuestros respectivos países, la segunda ola. En varios de los artículos que aquí aparecen hay referencias, explícitas o implícitas, vagas o concretas, a la situación de confinamiento o a la enfermedad y sus efectos. Ya sea al abordar el auge de los populismos, como lo hace el Profesor Boëne, ya sea al ocuparse del teletrabajo, como lo hace Chiara Furios, los efectos de la COVID-19 se dejan notar.

La apertura de la revista hacia las nuevas tecnologías, que ha provocado, meses atrás, incluso, el cambio del nombre de la revista, se justifica por la presencia de textos con referencias continuas al ámbito electrónico; ya sea la tecnología DLT, que aborda Rubén Rodríguez Abril, ya sea la desinformación electoral, que aborda la Profesora Loreto Corredoira, ya sea la digitalización en un país concreto, como es el caso de México visto por la Profesora Miryam Alcalá o de una Institución específica, como se ve en el estudio de Edgar Vázquez y Jorge Romero, va quedando poca duda del vuelco consumado en el ámbito de la información y, por lo tanto, del derecho a la información. Ahonda también en ciertos aspectos de la comunicación ideológica el Profesor González Requena, al interesarse por las encuestas políticas.

No nos abandonan, desde luego, las preocupaciones por los estudios fundamentales. En esta línea, el trabajo de Elisa Gutiérrez García sobre el concepto de obra audiovisual o el análisis del Profesor González Radío, sobre la contratación pública y la transparencia. También, sobre la transparencia, ha valorado la Redacción que debía incluirse el Informe TRA.BU.COM. (el grupo consolidado de la Universidad Complutense “Transparencia, Buena Gobernanza y Comunicación, 931036”) que respalda el III Diploma a la Universidad Pública Española Más Transparente (2020), recaído sobre la Universidad Autónoma de Madrid, a la que felicitamos desde aquí. 

Es para nosotros un motivo de tristeza, humana, que disculparán los lectores, y compartirán, seguramente, confirmar el fallecimiento de un miembro de la comunidad derecom. Rosa María Ortiz Hernández ha sido una autora ilustrada, primero, y una árbitro delicada y profunda, después. Profesora de la Universidad de Guanajuato (México), en la División de Ciencias Naturales y Exactas, estaba especializada en gestión e innovación tecnológica. Vino de la mano de Leticia Porto Pedrosa y ya se quedó.

La doctora Porto Pedrosa, que tantos servicios ha prestado a esta revista, se refiere a ella como Rosi Ortiz, tal como le gustaba que la llamasen sus amigos, y nos informa de que nos abandonó a finales de noviembre de 2019 “dejando un tremendo hueco que no será fácil cubrir por su enorme valía y su inmenso corazón. Nunca se cansó de luchar... Y ha sido un gran ejemplo de superación y constancia durante estos años para todas las personas que hemos tenido el placer de conocerla y de compartir su amistad. Ella se hacía sentir como parte de la familia, por su calidez, por su sencillez, con esa dulzura que siempre tenía en sus palabras y dispuesta a sonreír en todo momento para hacer más llevadero lo que tocaba. La vida no se lo había puesto fácil, pero ella supo sacar lo mejor hasta de un proceso tan duro como la enfermedad por la que atravesó durante largos años sin dejar de cosechar méritos. Entre sus principales logros destacan, además de la mencionada exitosa carrera como Profesora de la Universidad de Guanajuato, sus puestos como Coordinadora de la Maestría en Gestión e Innovación Tecnológica y Vicepresidenta de AISOC (Asociación Iberoamericana de Investigación en Sociología de las Organizaciones y Comunicación). Son múltiples sus facetas profesionales y personales que convirtieron a Rosi Ortiz en una mujer fuerte, valiente, generosa y extraordinariamente competente en el ámbito de la Sociología de las Organizaciones y la Comunicación. Le agradecemos su enorme implicación en nuestros proyectos y le deseamos un descanso eterno, con una mención especial de cariño hacia su hijo Omar y el resto de sus familiares y allegados”.

Solo nos queda recomendarles, queridos lectores, que, además de leer los trabajos que les presentamos en el número 29 de la revista, repasen los textos de Rosi Ortiz, que podrán encontrar en la hemeroteca de www.derecom.com y que llevan por título Innovación y conocimiento tecnológico en la sociedad del siglo XXI: la revolución de las TIC’S (número 13) y Del Gis al Tweet: Un Aula Global. La construcción de nuevos escenarios educativos a través del uso de TIC en el aula (número 11) y que ustedes respaldaron, en su momento (2013 y 2012) con 2245 y 2059 descargas, respectivamente. Hasta siempre, querida Rosi, hasta muy pronto, queridos lectores, si Dios quiere.

This deep text is made up of nine sections and a foreword. After hard eleven months trying to join judicial and political aspects and, above all, looking for the citizen´s participation to become a genuine fact or, as it is announced in the foreword, approaching participation “seriously” (p.18): foreword, introduction, framework of citizens´ participation in the drafting of laws, subject of study and methodology, orthodox and heterodox procedures of participation, sizing of participation and main actors, release of participation procedures, management of procedures and documents, empirical participation and analysis of participation, pieces of advise, best practices and patterns; here are the basic aspects that allow to understand administrative laws in a State of Law.

Summary

The subject of the degeneration of power is illustrated by R. Hochhuth in his work L'Antigone in Berlin, in which the author carries the symbolic and expressive load of the Greek myth within a real story. Antigone buries his brother, who died as an opponent of the regime, going against public prescriptions, which provided that the bodies of traitors had to be sent to the experiments of the institute of anatomy. In a burning Berlin, the description of Plötzensee prison, where the protagonist died and thousands of other political opponents with her, is emblematic of the brutality that Nazism reserved for its enemies, as well as of a power that had completely lost contact with reality. In a dramatic scenario, characterized by the exercise of almost total control of the Nazi institutions over the population and by law and propaganda according to the wishes of the authority, the desperate search for a tangible sign of something uncontaminated in the midst of horror emerges as well as the fundamentality of freedom of thought and conscience and more generally of human rights.

Summary

 The aim of this paper is to expose the results of a critical analysis of the speech applied to the Spanish System of Research and Evaluation legal framework. It will focus on strategic and essential concepts for the proper functioning of the system: transparency, excellence, quality, transfer and impact. The legal narrative around these ideas and how they have been conveyed to the evaluative practice of the scientific research will be examined. The way in which some paradigmatic Anglo-Saxon concepts such as impact and transfer have passed into the Spanish legal system and praxis will be criticized. The idea of assimilating the impact of science as an Impact Factor is of outstanding relevance. This assimilation without interpretation has produced a systematic lack of respect for the general principles of law that should be applied to the scientific evaluation according to the enacted regulation.

Summary

The present paper is the result of an investigation into the Spanish newsreel NO-DO that aims to shed some light on the political and propaganda purposes that led the Franco Regime to create a weekly, official and mandatory newsreel in 1942. It held the monopoly of cinematographic information throughout the dictatorship. The main goal of this essay is to highlight the role that NO-DO played in the Francoist propaganda network, immersed in a context of tight governmental control over the Media, focusing on the analysis of World War II coverage made by the Spanish newsreel.

 

The first NO-DO newsreel, created by the Order of December 17, 1942, was screened on January 4, 1943, when the balances of World War II forces began to change in favour of the Allies and the Head of the Spanish Government, Francisco Franco, had left behind two major internal crises in less than eighteen months and, beyond the difficulties arising from the international conjuncture, his position within the country was increasingly strong.

 

From then until the end of the war, the advance of the Allied troops marked the political and informative agenda of Franco's government, especially at international level, since it had to face strong pressure from Great Britain and the United States, as well as from monarchical and republican oppositions in exile.

Summary

In this paper we aim to study the public communication policies in Mexico, especially those created and implemented after the approval of the Telecommunications Reform of 2013 intended to eliminate monopolies. Based on the definition by van Cuilenburg and McQuail in  Media Policy Paradigm Shifts: Towards a New Communications Policy Paradigm, the Communications Policy has been updated and redefined due to the digital convergence of the media and telecommunications, coupled with the free market and technological transformations. These have been guided towards the regulation of the communication industries taking into account the concentration in large conglomerates, while promoting the development of society and the improvement of democracy. In this article, we analyze the impact of these policies on the regulation of monopolies in telecommunications and broadcasting in Mexico, specifically the actions implemented in Grupo Televisa and América Movil.

Summary 

In this paper the author proposes the implementation of a new model of Land Registry, which would run through automatic procedures of algorithmic character exclusively, and without any kind of human intervention. The system requires a property law based on an exhaustive list of rights in rem (numerus clausus) and an abstract system of title transfer, like the German one. The system would be implemented within a private blockchain governed by the Ethereum protocol, or a modified version of the same.

Summary

In this paper we go through the origin of Annual Reports of Transparency and national and EU regulations that provide for those reports and the values they try to guarantee with the dissemination of these reports, above all, trust, quality and independence.


The analysis of the transparency reports of two accounting firms allow us to scrutinise the degree of legal compliance. The data in these reports comes to be extremely valuable for citizens.

The results of our research prove that the degree of compliance of EU and national laws is total. Meeting regulations in this area raises consumers´ trust in accounting firms´ reports, in their high quality and in the independence of these companies.

These reports show some of the basic values of auditing, their relevance for career development, as well as the procedure for preserving them. In this paper we expose the procedures that guarantee independence and the repercussions of the latter.

Finally, due to the mandatory trait of the transparency reports, going deep into their way of working and the documents they are based upon may be a competitive advantage in labour life.
